General Terms and Conditions

I. Scope of Application

The following general terms and conditions (hereinafter: “GTC”) apply to all contract negotiations and contract conclusions that are conducted via the website www.hoerner-group.de (hereinafter: “Website”) with Hoerner Group GmbH, Oskar-Röder-Str. 3, 01237 Dresden, Germany, Tel.: +49 351 82619478, Email: info@hoerner-group.de, Register Court: Local Court Dresden, Register Number: HRB 44310 (hereinafter: “Hoerner” or “we”).

II. Contract Conclusion

The order of products and/or services on the website is directed to Hoerner as a binding purchase offer from the customer. The order is binding and can be revoked within 3 calendar days from the date of ordering. The order is revocable until the contract is concluded.

The contract is concluded with the acceptance of the order by us via email (“order confirmation”). We send the order confirmation to the email address provided by the customer during the order.

The contract text, which includes the order data and the GTC, is stored by us and sent to the customer via email. The customer has the option to save and print the contract text. After sending the order confirmation, the contract text is no longer accessible via the website.

The contract language is German.

III. Right of Withdrawal

According to Section 13 of the German Civil Code (BGB), the consumer has a right of withdrawal. The specific withdrawal notification, which includes the content of the right of withdrawal and the deadline for it, can be found in the respective ordering process.

IV. Delivery Conditions

The delivery of products and/or services to the customer is made to the delivery address provided by the customer during the order. Pickup from a collection point is not possible.

The delivery period is generally 3 calendar days from the date of ordering, unless otherwise agreed. This delivery period applies to delivery addresses in Germany. Different delivery times and costs for deliveries abroad are specified on the respective product page.

V. Payment Conditions

Payment for products and/or services can be made via advance payment (bank transfer), PayPal, immediate transfer (SOFORT), or credit card (Stripe). Payment by advance payment must be made within 10 calendar days from the date of ordering. Delivery of products and/or services will only take place after the amount has been credited to our account.

For payments via PayPal, SOFORT, and credit card (Stripe), your account will be charged upon conclusion of the contract.

The payment methods are selected and activated on the website.

VI. Retention of Title

The delivered products remain the property of Hoerner until they have been fully paid for.

VII. Warranty

If the customer is a consumer, the statutory warranty provisions apply.

If the customer is a business, the warranty period for new delivered products is 12 months from delivery. There is no warranty for used products.

The above warranty periods do not apply to damage claims that are based on the intentional concealment of defects, for the delivery of used items in case of defects that have occurred after delivery due to gross negligence of the seller, for the delivery of digital products, for the update of digital products, and for the delivery of software that is not delivered on data carrier media but can only be downloaded.

VIII. Special Provisions for Services According to Customer Specification

To the extent that Hoerner manufactures and/or provides products and/or services according to the customer’s specifications, the customer must provide the necessary content and rights for this purpose.

The customer warrants that the content provided by him and/or the rights granted by him do not infringe the rights of third parties.

The customer undertakes to indemnify Hoerner from any claims by third parties that relate to the content provided by the customer and/or the rights granted by the customer.

IX. Special Provisions for Promotional Vouchers

Promotional vouchers offered on the website are not for sale but are free incentives for ordering.

Only one promotional voucher can be used per order.

Promotional vouchers are not refundable and have a limited validity period.

Promotional vouchers are transferable.

If the customer exercises the right of withdrawal, there will be no refund of the promotional voucher.

X. Changes to the GTC or Our Services

We reserve the right to change the GTC if such a change is necessary to adapt to new legal regulations, new technical developments, experiences from operating the website, or the needs of the website users.

We will inform the customer about any changes to the GTC before they take effect. The amended GTC will be considered approved unless the customer objects within 6 calendar days after receiving the information about the changed GTC.

XI. Data Protection

The processing of the customer’s personal data in the context of contract fulfillment is governed by Hoerner’s privacy policy, which is accessible on the website.

XIII. Consumer Dispute Resolution Body

We are neither obliged nor willing to participate in a dispute resolution procedure before a consumer dispute resolution body.

XV. Applicable Law and Court of Jurisdiction

All contract negotiations and contract conclusions conducted via the website are governed by the law of the Federal Republic of Germany. The provisions of the UN Convention on Contracts for the International Sale of Goods (CISG) are expressly excluded.

If the customer is a company, the place of jurisdiction is the seat of Hoerner.
